To enroll for swim lessons, all clients are required to submit the online Terms & Conditions form before their first session. This form provides us with essential legal information needed to begin your lessons!
TERMS & CONDITIONS
Enrolment:
This Terms & Conditions Form must be signed digitally prior to the commencement of lessons. All-Aqua Limited (the “Company”) provides lessons on a term basis, the exact details of which can be located on the (annual calendar) (the “Term”). New clients are able to pay for their first lesson upfront before committing to the full Term, to ensure they are happy with the instructor, timing, and overall fit. Confirmation of continuing enrollment must be given two weeks before the end of the current Term (not including half-term breaks). A CI$10 administration fee per family is applied each Term to support scheduling, communication, and operational systems.
Payment Policy
Payment for the Term is due seven days before the first lesson. Any unpaid spots will be released to the waitlist after this deadline. No lesson will be held without confirmed payment. If a payment is made late, a late payment fee of CI$25 will be applied thereto. Payment plans may be offered on a case-by-case basis. These must be agreed upon in advance. If a payment plan is not honored, we reserve the right to cancel remaining lessons and release your space. Fees are subject to change at the discretion of the Company. The Company does not offer refunds for missed or unused lessons unless otherwise stated.
Make-Up / Missed Lessons Policy
Each full-term client is entitled to one make-up session per Term. This credit must be used within the same Term and is not transferable to another Term or swimmer. If you do not re-enroll, the credit will be forfeited. To be eligible for a make-up, 24 hours’ notice is required for the lesson to be eligible for rescheduling via email. Credits are not transferable between swimmers or Terms, and hold no cash value. If you have a pre-planned absence, we may be able to pre-schedule a make-up or apply the credit in advance, depending on availability. This must be arranged before the start of the Term. Lessons canceled by an instructor will be covered by a substitute, rescheduled, or credited to your account within that same Term. The 24-hour cancellation notice also applies to any make-up lessons. Credits are not carried forward unless otherwise agreed. In instances of medical or family emergencies, it will be at the discretion of the Company to choose to reschedule the lessons.
Pool Conditions
Please ensure your pool is well-maintained prior to the swimming lessons. We require a minimum water temperature of 76℉, along with the correct pH & chlorine levels. Debris must also be cleared. If your pool is in an unteachable state at the time of the lesson or within 24 hours prior, the session will be forfeited and not re-credited. This also applies post storm / hurricane / bad weather.
Weather Policy
Lessons canceled due to storms, lightning, hurricanes, or other uncontrollable events (Acts of Nature) will not be rescheduled or refunded. We swim in the rain - please ensure appropriate attire (such as a warm wetsuit) is worn during colder months. The Company will adhere to all Inclement Weather School Closures as implemented by the Ministry of Education or Government by cancelling lessons to avoid driving in unsafe conditions. If lessons are canceled due to hurricanes, natural events, or road closures beyond the Company's control, they will not be rescheduled or receive a credit. Please wait to hear from your instructor regarding any weather cancellations. If you are not contacted, assume your lesson will proceed as scheduled.
Baby Swim Policy (Up to 18 months)
The Company is aware that babies (up to 18 months old) require more specific weather and pool conditions. While a minimum pool temperature of 76°F is still used, additional accommodation for heavy rain will be granted by way of a credit. If you choose not to re-enroll, your credit will be forfeited. Instructors monitor lightning storms and lessons may be shortened or cancelled as a result. Lessons shortened or cancelled by lightning will not be made up or issued credits. Unless notified by your instructor, always assume the lesson is proceeding as scheduled.
Adult Group Swim Policy
Terms will be run in fixed week increments. The dates of your Term will be confirmed by your instructor. Due to the short format and group dynamic, we maintain a zero-cancellation policy for adult group swims. This ensures consistency and progress for all members. All group members must be enrolled before the Term begins. Additional participants may not join once the Term is underway. Once the Term has commenced, any group member unable to attend their lesson will not be permitted to send a replacement member in their stead. If a group member’s attendance becomes too inconsistent and affects the other group members’ progress, they may be removed from the group.
Liability Waiver
The enrolled participant(s) and/or the parent/guardian of the participant(s) agree and understand that swimming is a HAZARDOUS activity. The participant recognizes that there are risks inherent in taking swimming lessons, including but not limited to, paralyzing injuries and death. The participant hereby agrees to participate in All Aqua Limited swim lesson program and hereby agrees to indemnify and hold harmless the All Aqua Limited, its instructors, owners, management, agents and employees against any liability resulting from any injury that may occur to the participant while participating in the swim lesson program. The participant also agrees to indemnify All Aqua Limited for any damages incurred arising from any claims, demand, action or cause of action by the participant. The participant authorizes any representative of All Aqua Limited to have the participant treated in any medical emergency during their participation in the swim lesson program. Further, the participant and/or parent/guardian agree to pay all costs associated with medical care and transportation for the participant.
